In a recent development, a Federal High Court in Kano, presided over by Justice A. M. Liman, has issued a crucial injunction. This legal order effectively prevents the executive members of the All Progressives Congress (APC) at Ganduje Ward from suspending the party’s national chairman, Abdullahi Ganduje.
This injunction remains in force until the court can hear and decide on a lawsuit filed by Ganduje regarding the protection of his fundamental rights.
Ganduje, the former governor of Kano State, took this matter to court through his legal representative, Barrister Hadiza Nasir Ahmed.
They sought protection for Ganduje’s rights to fair hearing and freedom of association as stipulated under Section 46 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), and the Enforcement and Procedure Rules, 2009.
The court’s decision was made following the consideration of an ex parte motion submitted by Ganduje’s legal team. Justice Liman further directed all parties involved to maintain the status quo that existed before the purported emergency meeting where the suspension was discussed. Additionally, any actions related to the issue are to be halted until the motion on notice is heard and resolved.
The judge’s order explicitly restrains all respondents, including Basiru Nuhu Isah, the Nigeria Police Force, the Commissioner of Police (Kano Command), the Inspector General of Police, and the Department of State Service, from implementing or enforcing the alleged decision reached during the emergency meeting held by the APC Ganduje Ward on April 20, 2024.
The court has set the date of May 9, 2024, for the substantive hearing of the case.
