Alleged $6.2million Fraud: CBN Ex-Governor Emefiele Awarded Contracts Without Bidding Processes – Witness
Stephen Salau Gana, the 10th Prosecution Witness, (PW10) in the trial of former governor of Central Bank of Nigeria, Godwin Emefiele, has disclosed how Emefiele awarded contracts without bidding processes in violation of procurement act.
The Economic and Financial Crimes Commission (EFCC) is prosecuting Emefiele before Justice Hamza Mua’zu of the Federal Capital Territory, (FCT) High Court Maitama, Abuja on amended 20-count charges bordering on conspiracy, criminal breach of trust, conferment of corrupt advantages, forgery, and obtaining by false pretences to the tune of $6,230,000.
At the resumed trial on Thursday, Gana, who was head of CBN’s Procurement Office during Emefiele’s tenure told Justice Mu’azu that the company belonging to Sa’adatu Ramalan Yero, a staff of the apex bank was awarded a contract for the supply of vehicles to the CBN, valued at N99.9 million by direct procurement without a competitive bidding process.
Led in his testimony by prosecution counsel, Rotimi Oyedepo SAN, the witness revealed that a CBN governor’s threshold of contract approval was N100 million and that direct procurement was adopted only in cases where there was only one sole manufacturer, distributor or representative, or in cases of emergency or where the goods are available from only one source, adding, however, that none of these conditions applied to the company, April 16 16 in the contract award.
“April 16 16 was neither the sole manufacturer nor the sole distributor,” he told the court upon enquiry by the prosecuting counsel as quoted in a statement, by Dele Oyewale, EFCC’s Head, Media & Publicity.
Responding to a further enquiry on the possibility of April 16 16 having an exclusive dealership right on the vehicles supplied, the witness said, “No, they don’t have such rights.”
While the witness’s role as head of CBN’s Procurement Office was to provide leadership and oversee the procurement of goods and services, he told the court that he took no steps towards ascertaining if April 16 16 was the only available vehicle vendor.
The case was adjourned to November 13, 2024, for continuation of trial.

FG drops charges against journalists

The federal government on Friday withdrew all six-count charges against an Abuja-based online newspaper, Order Paper, and nine officers of the media organization.
Director-General of the Department of State Security (DSS), Mr. Tosin Adeola Ajayi advised the federal government to withdraw the charges.
It emerged Thursday that the Federal Government had sued the media house for allegedly publishing a false report that DSS operatives, on October 16, stormed the National Assembly on the basis of a rumoured plot to unseat Senate President Godswill Akpabio.
Considering what the DSS said was the serious national security threats and local and international embarrassment the story caused, they sued Order Paper and its officials.
However, a credible source in the office of the Director of Public Prosecution (DPP), who filed the suit, disclosed that the charges were withdrawn after the DSS boss reached out to their office.
“The new DG, DSS, Mr. Ajayi, reached out to us. He told my boss that the Nigerian chapter of the International Press Institute (IPI), which facilitated the early release of Order Paper’s admin officer, Ms. Edna Ulaeto, also played a key role. The people at Order Paper came to the DSS office, admitted their mistake, apologized, and promised to be more professional,” said the DPP officer.
From the visit of the Order Paper officials, the DSS boss further told my bosses, it was clear that the reporters were misled by less than credible sources in the National Assembly.
“Above all, added the DSS DG, the Order Paper management, on realizing their mistake, had quickly retracted the story. Being an adherent for civility, Mr. Tosin Ajayi therefore felt that the interventions by relevant professional bodies, including the IPI and Nigeria Union of Journalists, and the remorse by Order Paper, were sufficient to warrant the withdrawal of the charges,” the official of the Ministry of Justice declared.
