The court of appeal in Abuja has ordered Yahaya Bello, former governor of Kogi state, to present himself for arraignment by the Economic and Financial Crimes Commission (EFCC).
The court overturned the decision of a Kogi state high court that restrained the EFCC from prosecuting Bello over the allegation of N80 billion money laundering.
In a unanimous decision delivered on Tuesday, a three-member panel of the appellate court led by Ken Amadi also restrained the former governor from taking any further action regarding the charges against him until he has been formally arraigned.
The appeal was filed by the EFCC against the judgment of Isah Abdullahi Jamil, judge of the Kogi state high court, in a fundamental rights case instituted by Bello in February.
On February 9, the Kogi high court granted an interim injunction restraining the EFCC from “continuing to harass, threaten to arrest, detain, prosecute” Bello, his former appointees, and staff or family members, pending the hearing and determination of the substantive originating motion for the enforcement of his fundamental rights.
Since then, efforts to arrest and arraign the former governor, who is currently in hiding, have not been successful.
The appeal court described the judgment by the Kogi high court as “scandalous”.
Amadi held that it was very clear that the purpose of the case instituted at the trial court was “to shield the respondent, Yahaya Bello, from his criminal trial”.
The court also relied on the earlier decision of Olubunmi Oyewole JCA in EFCC vs. Alh. Yahaya Bello, CA/ABJ/CV/413/2024 to reiterate that “no court has the power to preclude a law enforcement agent from performing its statutory functions.”
On the whole, the court agreed with the submissions of the EFCC and held that the appeal is meritorious and is therefore allowed.
“In view of the provision of Section 396(2) of the Administration of Criminal Justice Act, ACJA, the respondent in this appeal, Alhaji Yahaya Adoza Bello, is hereby ordered to appear for his arraignment in Charge No.: FHC/ABJ/CR/550/2022, FRN VS ALI BELLO & ANOR, before taking any other step in this matter,” the court ruled.

Oyo 2027: Massive defections as PDP candidate, Accord aspirant, 3,000 others join APC
Ademola popularly known as Lucky, said his decision to leave the PDP was influenced by his assessment of the political situation in the state ahead of the 2027 elections.
“I did my due diligence and realised that any ticket outside the APC is a mere tissue paper that cannot take a candidate anywhere in 2027.
We are here in our hundreds to formally join the APC, and we promise to do our best in the interest of the progressive party and our dear country, Nigeria,” Ademola said.
Ojo, who was seeking the Accord ticket in the same constituency, also announced his decision to join the APC, describing his previous political efforts with Accord as unproductive.
We thought about making Accord a credible alternative in the state, but we later realised that the APC was far ahead of other parties.
“We wasted our time, energy and resources on an unproductive exercise. We later realised it wasn’t worth it, so we decided to pitch our tent with the progressive party,” Ojo said.
The defectors were received by the Oyo State Chairman of the APC, Chief Moses Alake-Adeyemo, who assured them that they would have equal opportunities within the party.

Civil Servant Takes Ex-Wife to Court Over House, Land Ownership Documents
A civil servant, Salihu Abdulkadir, has dragged his former wife, Balkisu Yunusa, before an Upper Area Court in Mararaba, Nasarawa State, over the documentation of his house and land following the dissolution of their marriage.
Abdulkadir, who appeared before the court, said he and his former wife both reside in Mararaba, within the Karu Local Government Area of the state.
He told the court that he owned a house and a parcel of land, adding that his former wife and their children were currently occupying one of the houses.
“My former wife and our children are currently living in one of the houses. I pray the court to help me document the property,” he said.
In her response, Yunusa, according to the News Agency of Nigeria (NAN), told the court that she was not responsible for the documentation of the properties.
Following the submissions, the presiding judge, Mohammed Shomo, adjourned the case to a later date for further proceedings.
The court is expected to continue hearing the matter as the dispute over the property documentation remains unresolved.
